Florida condominium associations are required by the Department of Business Regulation (DBR) to complete and submit a reserve study by January 1, 2025 having to do with reserves for major building components.

This update pertains to Florida's new legislation, mandating condominium associations to ensure compliance with the state’s requirements for a Structural Integrity Reserve Study (SIRS). This law enhances building safety and transparency.  This is the result of recent concerns regarding structural integrity as a result of the infamous Champlain Towers building collapse.

Key Points About the Structural Integrity Reserve Study:

Scope: SIRS must evaluate the structural soundness of critical elements, including the roof, foundation, load-bearing walls, plumbing, and electrical systems, among others.

As part of this new law, it’s crucial that lenders and other interested parties review these studies when looking at condominium properties for mortgage financing, buying and for disclosures when selling.
